Specifics:

What do we outside Cuba know about Cuba inside and how do we know it? Are Intellectual Property Rights violated in Cuba? i.e. State Leadership)If you believe this is a trick question, you may be quite right!!!!

For example, in Cuba, who owns property? (Keep in mind this may well be a key concept in Cuban law.)

In that this is a cyberlaw course, the legal concept of patrimony in The Constitution of the Republic of Cuba should be considered.

[Hint: keep in mind that Fidel Castro is an attorney. "In 1945 he enrolled at the University of Havana, graduating in 1950 with a law degree." http://www.geocities.com/CapitolHill/3240/castro.html)

"The concept of "socialist state patrimony" is broadly defined by Article 15 of the national Constitution to include "all lands not owned by small agricultural producers or cooperatives formed by small agricultural producers, the subsoil, mines, living and nonliving natural resources located within the economic maritime zone of the Republic, forests, waters, roads, sugar mills, factories, fundamental means of transportation, and all enterprises, banks and installations which have been nationalized and expropriated from the imperialists, large landowners and bourgeois, as well as the factories, enterprises and economic installations and scientific, social, cultural and sports centers constructed, developed or acquired by the State, and those which it may construct, develop or acquire in the future." http://www.natlaw.com/cuba/spcurp1.htm)

What is your opinion about the following comment from the U.S. Department of State namely Colin Powell's people and soon to be Condi Rice's? (Cite your sources by surfing the web. Would you quote C. Rice for example? Would she have expressed an opinion while at Stanford, for example. Is Dr. Rice an individualist?)

"In terms of intellectual property, although Cuba theoretically issues patents to individual inventors, the patent holder has a binding “social obligation” to license/transfer the patent to the state in order to “benefit” society." Commission for Assistance to a Free Cuba, Released by the Bureau of Western Hemisphere Affairs, U.S. Department of State, May 6, 2004, http://www.globalsecurity.org/military/library/report/2004/32251pf.htm

Is there a violation of rights? If so, which rights and what are your sources? What does your own sense of leadership tell you?

Eric J. Lindblom, Ph.D.

The project leader, Eric J. Lindblom, Ph.D., has a Doctorate of Philosophy in Psychology (Humanistic, Transpersonal and Organizational Systems) from Saybrook Graduate School and Research Center in San Francisco, California, U.S.A., the premier school in the Humanistic Psychology tradition.

(See: http://www.saybrook.edu)

Saybrook is the former Institute for Humanistic Psychology formed by internationally known psychologists led by Drs. Carl Rogers and Abraham Maslow. Thereby, this cyberlaw course and others led by Dr. Lindblom represent the philosophy of law not the practice. It is expected that the views represented in this (these) course(s) would reflect a philosophical perspective elaborated in General Systems Theory/Organizational Systems thinking.

* What is Course Work? "CourseWork is Stanford University's course Web site development and distribution system. Using CourseWork, instructors and TAs can set up a course Web site that displays announcements, on-line readings, a dynamic syllabus and schedule, on-line assignments and quizzes, a discussion forum for students, and a grade book. CourseWork is designed both for faculty with little Web experience, who can use CourseWork to develop their Web site quickly, and for expert Web-users, who can use it to organize complex, Web-based materials and link them to Web communication tools."http://aboutcoursework.stanford.edu/overview.html
