I.A. What Guides the Deciders? - The Courts' Sources of Authority

by Jonathan Zittrain Show/Hide

There are a plethora of sources from which courts draw upon to guide their opinions. Consider reading Mandatory v. Persuasive Cases from this section's supplemental playlist to familiarize yourself with different types of sources of legal authority.

Review the cases. Take note of the authorities cited by the courts. To what extent does the court cite state statutes (‘statutory law')? To what extent does the court cite previous cases (in other words, the ‘common law')? Are there any other sources that the court seems to rely upon? Do the opinions in these tort cases seem to rely more heavily upon a particular type of law?
