    Should courts recognize a license to engage in contact with another, even if that license was obtained through deceit?
    Notes:
    Plaintiff and defendant were wife and husband. During their marriage, defendant husband engaged in an extramarital affair. While she was unaware of the affair, plaintiff continued to have sexual intercourse with her husband. The plaintiff then sued the husband for battery, on the theory that she would not have consented to sex if she had known about the affair at the time.
