      Should animal welfare activists be able to go to civil court to obtain a declaration that a person responsible for an animal is in breach of animal welfare legislation? If not, how can we be sure that animal protection law will be effective? Animals themselves have no standing and no ability to enforce the legal protections that are supposed to be for their benefit.

      Defendant carried on an animal control business, including capturing strays and killing them if they were unclaimed after three days. He killed unclaimed strays by carbon monoxide poisoning. He was convicted of animal cruelty under the Criminal Code because the killing method caused substantial suffering, and less painful methods were available.
